By accessing and using DMpro ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.
2. Description of Service
DMpro provides Twitter/X direct message automation services, including lead discovery, AI-powered message personalization, campaign management, and analytics. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. User Accounts
To use our Service, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Acceptable Use
You agree NOT to use the Service to:
- Send spam, unsolicited messages, or harassing content
- Send spam, harassing, or abusive content via Twitter/X
- Engage in any illegal or fraudulent activities
- Impersonate others or misrepresent your affiliation
- Distribute malware, viruses, or harmful code
- Attempt to gain unauthorized access to systems or data
- Interfere with or disrupt the Service
5. Twitter/X Account Risks & Disclaimer
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.
5.1 Assumption of Risk
You acknowledge and agree that the use of any third-party automation tool, including DMpro, carries inherent risks to your Twitter/X account. These risks include but are not limited to: account suspension, temporary or permanent bans, rate limiting, restricted functionality, shadowbanning, or any other enforcement action by Twitter/X ("Account Restrictions").
5.2 No Responsibility for Account Restrictions
DMpro is NOT responsible, liable, or accountable for any Account Restrictions imposed on your Twitter/X account(s) as a result of using our Service. You use DMpro entirely at your own risk.
5.3 No Guarantees
We do not guarantee, represent, or warrant that:
- Your Twitter/X account will remain in good standing
- Your account will not be suspended, banned, or restricted
- Twitter/X will not change its policies, enforcement, or detection methods
- Our safety features or rate limits will prevent Account Restrictions
5.4 Your Responsibility
You are solely responsible for:
- Setting appropriate messaging volumes and frequency
- The content of all messages sent through our Service
- Monitoring your account status and adjusting usage accordingly
5.5 Indemnification for Account Restrictions
You agree that you will not hold DMpro liable for, and you release DMpro from, any and all claims, damages, losses, or costs arising from Account Restrictions on your Twitter/X account(s). You will not seek refunds, chargebacks, or compensation from DMpro based on Account Restrictions.
5.6 Changes to Twitter/X Platform
Twitter/X may change its terms, APIs, detection methods, or enforcement policies at any time without notice. DMpro has no control over these changes and bears no responsibility for their impact on your account.
6. Payment Terms
For paid subscriptions:
- Payments are processed securely through our payment provider
- Subscriptions renew automatically unless cancelled
- Prices may change with 30 days advance notice
- Refunds are available within 7 days of purchase
- You may cancel your subscription at any time
- Account suspensions, bans, or restrictions imposed by Twitter/X on your account do not entitle you to any refund, credit, or chargeback. By using DMpro, you accept full responsibility for these risks.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by DMpro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, or distribute our proprietary materials without prior written consent.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of Liability
In no event shall DMpro, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Indemnification
You agree to defend, indemnify, and hold harmless DMpro and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
